Sachverhalt

Eine Steuerpflichtige wollte einem im Tierheim lebenden (kaum mehr vermittelbaren) „Problemhund“ durch die dauerhafte Unterbringung in einer gewerblichen Tierpension helfen. Zu diesem Zweck übergab sie bei einem Treffen mit einer Vertreterin eines gemeinnützigen Tierschutzvereins und der Tierpension 5.000 EUR. Der Tierschutzverein stellte eine Spendenbescheinigung aus.

Sowohl das Finanzamt als auch das Finanzgericht Köln lehnten einen Spendenabzug ab. Die hiergegen eingelegte Revision war erfolgreich.

Ein konkreter Verwendungszweck der Spende steht dem steuerlichen Abzug nicht entgegen. Entscheidend ist, dass der Empfänger die Spende nicht annehmen muss. Denn er trifft die Entscheidung, ob und wie er seine steuerbegünstigten Zwecke im Einzelfall fördern möchte.

Im zweiten Rechtsgang wird nun das Finanzgericht Köln unter Heranziehung der Satzung und weiterer Unterlagen (z. B. Tierheimordnung und Nachfrage beim Deutschen Tierschutzbund e. V.) feststellen müssen, ob bzw. unter welchen Voraussetzungen die Dauerunterbringung eines Hundes in einer gewerblichen Tierpension zur Förderung des Tierschutzes in Erwägung zu ziehen ist.

Die notwendige Unentgeltlichkeit der Zuwendung fehlt zwar, wenn sie einer konkreten Person zugutekommen soll und hierdurch letztlich verdeckt Unterhalt geleistet oder eine Zusage erfüllt wird. Dies war aber hier nicht der Fall, zumal der Hund der Steuerpflichtigen nicht gehörte.
