Durch das Sozialschutz-Paket vom 27.3.2020 wurden die Zeitgrenzen für eine sozialversicherungsfreie kurzfristige Beschäftigung übergangsweise vom 1.3. bis zum 31.10.2020 von drei Monaten oder 70 Arbeitstagen auf fünf Monate oder 115 Arbeitstage angehoben. Hier stellt sich nun u. a. die Frage, welche Zeitgrenze gilt, wenn eine Beschäftigung über den 31.10.2020 hinausgeht. |

Ab dem 1.11.2020 liegt eine kurzfristige Beschaftigung nur noch vor, wenn die Beschaftigung unter Berücksichtigung von Vorbeschaftigungszeiten seit ihrem Beginn in 2020 auf langstens drei Monate bzw. 70 Arbeitstage befristet ist.

Beispiel

A beginnt zum 1.7.2020 eine Beschäftigung. Die Anstellung ist bis zum 30.11.2020 befristet.

Mit Beschäftigungsbeginn liegt eine kurzfristige Beschäftigung vor, da die erhöhten Zeitgrenzen anzuwenden sind. Zum 1.11.2020 ist die Beschäftigung neu zu beurteilen. Da hier wieder die „alten“ Grenzen gelten, liegt ab dem 1.11. keine kurzfristige Beschäftigung mehr vor.
