Monatliche Umsatzbeteiligungen erhöhen das Elterngeld. Das hat das Landessozialgericht Niedersachsen-Bremen bei einer angestellten Zahnärztin entschieden (Revision zugelassen). Ihr Arbeitgeber zahlte eine monatliche Grundvergütung und Umsatzbeteiligungen, die zwischen 140 EUR und 2.300 EUR pro Monat schwankten. |

Bei den monatlichen Umsatzbeteiligungen handelt es sich um laufenden Arbeitslohn. Denn die Beteiligungen werden nach den arbeitsvertraglichen Vereinbarungen jeweils bezogen auf einen Monat berechnet und gezahlt. Die Beteiligung ist somit einem Lohnzahlungszeitraum zugehörig und muss dem Arbeitslohn zugerechnet werden. Solange die Konkordanz zwischen dem Monatszeitraum und dem variablen Lohnbestandteil gewahrt bleibt, wirkt sich dies auch auf das Elterngeld aus.
