Kann auch der Betreuungsfreibetrag für volljährige Kinder übertragen werden?

Bei nicht verheirateten, geschiedenen oder dauernd getrennt lebenden unbeschränkt steuerpflichtigen Eltern wird auf Antrag eines Elternteils der Kinderfreibetrag des anderen Elternteils auf ihn übertragen, wenn der andere Elternteil z. B. seiner Unterhaltspflicht für das Kalenderjahr nicht nachgekommen ist. Umstritten ist, ob in diesen Fällen der Freibetrag für den Betreuungs- und Erziehungs- oder Ausbildungsbedarf (BEA-Freibetrag) zwangsläufig dem Kinderfreibetrag folgt. |

Hintergrund

Jeder Elternteil hat im Veranlagungszeitraum 2019 grundsätzlich Anspruch auf einen Freibetrag von 2.490 EUR für das sächliche Existenzminimum des Kindes (Kinderfreibetrag) sowie auf einen BEA-Freibetrag von 1.320 EUR.

Entscheidung

Nach einer Entscheidung des Finanzgerichts Schleswig-Holstein wird der BEA-Freibetrag nur bei minderjährigen Kindern übertragen. Eine Übertragung des Freibetrags für volljährige Kinder ist dagegen vom Gesetz nicht vorgesehen. Es bleibt somit auch dann bei einer hälftigen Zuordnung des BEA-Freibetrags, wenn einer der Eltern keine Unterhaltsaufwendungen trägt.

Beachten Sie | Mit dieser Entscheidung hat sich das Finanzgericht gegen die Auffassung der Finanzverwaltung gestellt. Nach deren Sichtweise führt die Übertragung des Kinderfreibetrags nämlich stets auch zur Übertragung des Freibetrags für den Betreuungs-, Erziehungs- oder Ausbildungsbedarf. Da gegen das Urteil des Finanzgerichts Schleswig-Holstein inzwischen die Revision anhängig ist, wird der Bundesfinanzhof hier bald für Klarheit sorgen können.
