Das Finanzgericht Hamburg hat die Klage eines Dieselfahrers abgewiesen, der mit Blick auf die Dieselfahrverbote eine Herabsetzung der Kraftfahrzeugsteuer begehrte. Weil das Finanzgericht die Revision nicht zugelassen hat, hat der Steuerpflichtige Nichtzulassungsbeschwerde beim Bundesfinanzhof eingelegt. |

Sachverhalt

Der Halter eines Diesel-Pkw, der die Emissionsklasse Euro 5 erfüllt, wehrte sich gegen die Festsetzung der Kraftfahrzeugsteuer. Weil in einzelnen Städten und Gemeinden die Straßennutzung für seinen Pkw durch Dieselfahrverbote eingeschränkt werde, widerspreche die Steuerfestsetzung dem Grundsatz der Gleichmäßigkeit der Besteuerung.

Besteuerungsgrundlage sei der Schadstoffausstoß. Durch das Fahrverbot sei sein Fahrzeug potenziell weniger schädlich, weil es in den Fahrverbotszonen keine Stickoxide mehr ausstoße. Doch dieser Auffassung ist das Finanzgericht Hamburg nicht gefolgt.

Der Besteuerungstatbestand ist bereits verwirklicht, wenn das Fahrzeug nach den verkehrsrechtlichen Bestimmungen zum Verkehr zugelassen wurde. Ob das Fahrzeug überhaupt genutzt wird und welche Straßen befahren bzw. nicht befahren werden, ist nach der gesetzlichen Ausgestaltung der Kraftfahrzeugsteuer unerheblich.

Dass der Steuerpflichtige mit seinem Euro-5-Fahrzeug wegen zwischenzeitlich von einzelnen Kommunen (wie auch der Freien und Hansestadt Hamburg) verhängter Fahrverbote einzelne Straßen nicht befahren darf, berührt daher die Festsetzung der Kraftfahrzeugsteuer nicht. Eine Reduzierung bzw. Aufhebung der Kraftfahrzeugsteuer ist gesetzlich nicht vorgesehen.
