Kindergeld: Großeltern können berechtigt sein

| Auch Großeltern können Kindergeld bekommen – nämlich dann, wenn sie Enkel überwiegend in ihrem Haushalt versorgen und betreuen. Jüngst hat sich das Finanzgericht Rheinland-Pfalz mit dieser Thematik näher befasst. |

Gibt es einen gemeinsamen Haushalt von Eltern/Elternteil und Großeltern, ist gesetzlich geregelt, dass das Kindergeld vorrangig den Eltern bzw. dem Elternteil zusteht. Auf den Anspruch kann aber zugunsten eines Großelternteils verzichtet werden.

Nicht gesetzlich geregelt ist der Fall, wenn kein gemeinsamer Haushalt vorliegt und sich das Kind sowohl im Haushalt der Eltern bzw. eines Elternteils als auch im Haushalt der Großeltern aufhält. Das Finanzgericht vertrat die Ansicht, dass es hier keinen vorrangigen Anspruch der Eltern gibt und festgestellt werden muss, in wessen Haushalt das Kind seinen Lebensmittelpunkt hat. Ein Verzicht der Eltern auf den Kindergeldanspruch reicht nicht aus.

Im Streitfall war für das Finanzgericht entscheidend, dass das Kind in deutlich überwiegendem Umfang von den Großeltern versorgt, betreut und erzogen wurde. Zudem hätten sich die Großeltern auf eine dauerhafte Betreuung eingerichtet und auch ihre berufliche Situation darauf ausgerichtet.
