| Das Finanzgericht Niedersachsen ist überzeugt, dass die Kinderfreibeträge (nicht nur) im Streitjahr 2014 in verfassungswidriger Weise zu niedrig bemessen sind. Es hat daher ein Klageverfahren ausgesetzt und das Verfahren dem Bundesverfassungsgericht vorgelegt. Die weitere Entwicklung bleibt also vorerst abzuwarten. |

Hintergrund: Die Höhe des von der Steuer freizustellenden Existenzminimums wird alle zwei Jahre von der Bundesregierung ermittelt. Auf Grundlage dieser Ermittlung wird bei der Festsetzung der Einkommensteuer für jedes Kind ein Freibetrag für das sächliche Existenzminimum und ein Freibetrag für den Betreuungs- und Erziehungs- bzw. Ausbildungsbedarf abgezogen. Der nach einer Durchschnittsberechnung vom Gesetzgeber festgelegte Kinderfreibetrag legt für alle Kinder ein sächliches Existenzminimum zugrunde, das – so das Finanzgericht – niedriger ist als der sozialhilferechtliche Regelbedarf eines Kindes ab dem 6. Lebensjahr. Das gilt auch für ältere oder volljährige Kinder, die z. B. wegen einer Ausbildung oder als behinderte Kinder zu berücksichtigen sind.

Beachten Sie | Das Finanzgericht hat darauf hingewiesen, dass auch die Erhöhung des Kinderfreibetrags ab 1.1.2017 nichts an der Problematik ändert, weil die Berechnungsmethode unverändert bleibt.
