| Das Finanzamt ist berechtigt und verpflichtet, einer gesetzlichen Krankenversicherung auf Antrag die für eine Beitragsbemessung freiwillig versicherter Mitglieder notwendigen Besteuerungsgrundlagen mitzuteilen. Hierzu gehören auch die Einkünfte des Ehegatten, der kein Mitglied einer gesetzlichen Krankenversicherung ist. Dies hat das Finanzgericht Baden-Württemberg entschieden und die Revision zugelassen. |

Beachten Sie | Die Entscheidung betrifft Veranlagungszeiträume vor 2015. Seit 2015 ist eine gesetzliche Neuregelung zu beachten. Danach ist die Festsetzung von Höchstbeiträgen nunmehr nicht nur für freiwillig hauptberuflich selbstständige Mitglieder, sondern für alle freiwillig Versicherten möglich, sofern das Mitglied auf Verlangen der Krankenkasse Einnahmen nicht nachweist. Die Mitteilung von Besteuerungsgrundlagen ist daher für die Beitragsbemessung nicht mehr erforderlich.
