Nachgezahlter laufender Arbeitslohn, den der Elterngeldberechtigte außerhalb der für die Bemessung des Elterngelds maßgeblichen 12 Monate vor dem Monat der Geburt des Kindes (Bemessungszeitraum) erarbeitet hat, ist der Bemessung des Elterngelds zugrunde zu legen, wenn er im Bemessungszeitraum zugeflossen ist. Denn entscheidend ist, welches Einkommen der Berechtigte im Bemessungszeitraum hat. So lautet eine aktuelle Entscheidung des Bundessozialgerichts. |

Der im Streitfall beklagte Landkreis war deshalb nicht berechtigt, die von der Steuerpflichtigen im Juni 2013 vor dem Bemessungszeitraum (Juli 2013 bis Juni 2014) erarbeitete Gehaltsnachzahlung bei der Berechnung des Elterngelds auszuklammern. Maßgeblich war vielmehr, dass ihr diese Gehaltsnachzahlung im August 2013 und damit im Bemessungszeitraum tatsächlich zugeflossen war.
