Beim Finanzgericht Münster ist ein Verfahren anhängig, das den Verkauf von Backwaren und anderen Lebensmitteln zum Verzehr an Ort und Stelle von Bäckereifilialen betrifft. Hierbei kann es sich sowohl um Fachgeschäfte (Bäckerei mit eigenem Cafe) als auch um Filialen im Vorkassenbereich von Supermärkten handeln. Die Oberfinanzdirektion Nordrhein-Westfalen hat ihre Finanzämter nun angewiesen, wie derartige Umsätze umsatzsteuerrechtlich zu behandeln sind. |

Die Lieferung von Speisen zum Verzehr an Ort und Stelle unterliegt dem Regelsteuersatz von 19 %, wenn die vorhandenen Sitzgelegenheiten

  • im Eigentum der Bäckerei stehen,
  • angemietet wurden oder
  • zumindest deren Mitnutzung ausdrücklich vereinbart wurde.

Können die Sitzgelegenheiten nicht der Bäckerei zugerechnet werden oder sind keine Sitzgelegenheiten vorhanden, ist der ermäßigte Umsatzsteuersatz anzuwenden.
